26 August 2020: Land and Environment Court news

The Attorney General is seeking applications from qualified persons for appointment as Acting Commissioners of the Land and Environment Court of NSW to exercise the jurisdiction of the Court in matters across Classes 1 and 2 involving town and country planning, architecture, urban design, heritage and law relating to these disciplines. There are a number of positions available. Acting Commissioners can be appointed for terms of different lengths. In this instance a term could be up to 3 years. Acting Commissioners can be reappointed for a further term.

Acting Commissioners exercise the jurisdiction of the Court to determine certain of its cases, either by conciliation or hearing on the merits (either by themselves or with another Commissioner), as the Chief Judge may arrange. They may also be called upon to assist a Judge of the Court when the Judge is exercising the jurisdiction of the Court.

Appointees must have relevant qualifications under section 12 of the Land and Environment Court Act 1979, particularly with special knowledge and expertise in the areas of town and country planning, architecture, urban design, heritage and law relating to these disciplines.

Appointees must comply with, for the duration of any appointment, the pecuniary interest and conflict of interest provisions in sections 12(2B) and 14(1) of the Land and Environment Court Act 1979.

Acting Commissioners can work on a full time, part-time, part-year or other flexible basis.

Acting Commissioners daily rate $1250

Note: Probity checks will be conducted.
