Transparent and consistent sentencing in the Land and Environment Court

 

EPLA is hosting a seminar presented by Michael Cain and Hugh Donnelly of the Judicial Commission of NSW on the topic of sentencing in the Land and Environment Court following the release of Research Monograph 40 - Transparent and consistent sentencing in the Land and Environment Court: orders for costs as an aspect of punishment.

The study makes extensive use of 15 years of sentencing data from the Land and Environment Court sentencing database.

The authors will report the key findings of the study, including the impact of costs orders on the sentencing process and identify areas where the sentencing process could be improved.  The study also comprises comprehensive Case Tables for pollute water offences, waste offences and native vegetation offences, with an explanation from the authors how they were complied, and how they can be used in practice.
